On 12 - 16 January 2026, Mr. Songchai Chaipatiyut, Deputy Director-General of Treaties and Legal Affairs Department, led the Thai delegation to the 53rd Session of UNCITRAL Working Group III to participate in discussions on the Investor-State Dispute Settlement (ISDS) reform. The Thai delegation comprised representatives from the Ministry of Foreign Affairs, senior officials from the Office of the Attorney-General, and an expert in international investment law and arbitration from the Faculty of Law, Thammasat University.
The Meeting continued deliberations on the Draft Provisions on Procedural and Cross-Cutting Issues, covering procedural matters, such as counterclaims and third-party funding. Thailand, as both capital exporter and receiver, aims to ensure that the Draft Provisions strike an appropriate balance between protecting the Thai investors abroad and maintaining the State’s right to regulate.
On 12 January 2026, the Thai delegation attended an informal briefing on the Third Advisory Centre Operationalization Meeting (AC-OP) held on 1 - 3 December 2025 in Paris. Thailand, as a candidate to host the headquarters of the Advisory Centre, reaffirmed its commitment to host the Advisory Centre in Bangkok and its readiness to facilitate the discussion on the location(s) of the Advisory Centre through the Vienna-based “Friends of the Advisory Centre (FoAC)” mechanism during the 54th session of the UNCITRAL Working Group III, which is scheduled in March 2026 in Vienna. This initiative aims to meet the timeline for submitting this matter to the UNCITRAL Commission for its decision at its 59th session in June - July 2026. Thailand’s proactive engagement in the ISDS reform enhances its international recognition and reinforces confidence in the country’s constructive role in international investment law development and its vision to be an international hub for international trade and investment.
On this occasion, Deputy Director-General of Treaties and Legal Affairs Department also paid a courtesy call on Ms. Elinor Jane Hammarskjöld, Under-Secretary-General for Legal Affairs and United Nations Legal Counsel (OLA), to exchange views on issues pertaining to international law.
